Free Service

Harmonoise is provided completely free of charge. There are no subscription fees, premium tiers, or hidden costs. We reserve the right to introduce paid features in the future, but core functionality will always remain free.

Intellectual Property

The Service, including all code, design, text, graphics, and other content (excluding user-generated content), is owned by Harmonoise and is protected by copyright, trademark, and other intellectual property laws.

While we don't collect or store any user data, any feedback, suggestions, or ideas you provide about the Service may be used by us without any obligation to you.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability, fitness for a particular purpose, or non-infringement
  • Warranties that the Service will be uninterrupted, error-free, or completely secure
  • Warranties regarding the accuracy or reliability of any tools or results
  • Warranties that the Service will meet your specific requirements

While we strive for accuracy and reliability, we cannot guarantee that the pitch detection, BPM calculation, frequency generation, or other tool outputs will be 100% accurate in all situations. Professional-grade equipment should be used for critical applications.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HARMONOISE SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Damage to hearing or audio equipment from improper use of frequency generators or metronomes
  • Mistakes in tuning, timing, or musical performance based on tool outputs
  • Service interruptions, downtime, or loss of access

This limitation applies whether based on warranty, contract, tort, or any other legal theory, even if we have been advised of the possibility of such damages.

Hearing Safety

IMPORTANT: The frequency generator, noise generator, and other tools can produce sounds at high volumes. Prolonged exposure to loud sounds can cause permanent hearing damage.

You are responsible for:

  • Setting volume levels safely and responsibly
  • Protecting your hearing when using these tools
  • Taking breaks during extended listening sessions
  • Consulting hearing health professionals if you experience discomfort

Harmonoise is not liable for any hearing damage, tinnitus, or other hearing-related health issues that may result from improper use of the Service.

Equipment Safety

Test tones, especially at high volumes or extreme frequencies, can potentially damage speakers, headphones, or other audio equipment. You are responsible for using the tools appropriately for your equipment's capabilities. Harmonoise is not liable for any equipment damage.

Third-Party Links

While Harmonoise currently does not include links to third-party websites, if we add such links in the future, we are not responsible for the content, privacy practices, or terms of service of external sites.

Modifications to Service

We reserve the right to:

  • Modify, suspend, or discontinue any part of the Service at any time
  • Add new features or tools
  • Remove or alter existing tools
  • Change the Service's appearance, functionality, or performance characteristics

We will make reasonable efforts to notify users of significant changes, but we are not obligated to do so.

Modifications to Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Continued use of the Service after changes constitutes acceptance of the new Terms.

For significant changes that materially affect user rights, we will provide more prominent notice on the website before the changes take effect.

Termination

We reserve the right to terminate or suspend access to the Service for any user who violates these Terms, though given the Service's architecture (no accounts, no data collection), enforcement is limited to IP-based blocking in extreme cases of abuse.

You may stop using the Service at any time by simply closing your browser or navigating away from the website.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law provisions.

Dispute Resolution

Any disputes arising from these Terms or use of the Service should first be addressed through informal negotiation by contacting us at [email protected]. If informal resolution fails, disputes will be resolved through binding arbitration in accordance with the rules of [Arbitration Organization] in [Your Jurisdiction].

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Harmonoise regarding the Service and supersede all prior agreements and understandings.

No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver must be in writing and signed by us to be effective.
